TERMS OF SERVICE

1. General

These Terms of Service apply to all services and digital products (such as marketing systems, consulting, automation and educational programs) provided by Buchanon Company Ltd (Company No: 11111405, VAT: FI30165578, operating from Sankt Gallen, Switzerland), hereinafter referred to as "the Company".

2. Agreement and Duration

The service agreement is one-time unless otherwise agreed. The agreement is formed when the Client purchases a service from the Company. The agreement ends when the service has been delivered or the agreed contract period ends.

3. Scope of Services

The Company provides digital marketing services including (but not limited to): funnel building, automation setup, CRM integration, media buying, reporting tools, educational content, strategic consulting, and related support services. The exact scope is defined in writing per Client project.

4. Client Responsibilities

The Client is responsible for:

• Providing timely content for marketing and automations (text, video, image materials).
• Funding the agreed advertising budget and giving account access where needed.
• Managing and closing sales calls generated by the system.
• Ensuring that their business complies with all applicable laws.

5. No Guarantees or Financial Advice

The Company does not guarantee specific results (such as number of leads or ROI) unless expressly agreed in writing. All examples, testimonials, or use cases are for illustrative purposes only. The service is not financial advice or individualized business consultancy.

6. Intellectual Property

All materials, systems, content, and documentation created remain the intellectual property of the Company unless explicitly transferred. The Client receives a usage license for internal business purposes only. Redistribution, reselling, or public sharing is prohibited.

7. Payment Terms

Payments are due in advance unless otherwise agreed. For payment via invoice, standard NET 7 terms apply. Late payments are subject to interest and collection fees. Payment service providers include Stripe and PayPal. For installment plans, the Client agrees to all future installments at the time of purchase.

8. Refund and Cancellation Policy

There are no refunds or cancellations unless otherwise explicitly stated. Digital products and services are delivered immediately and are non-refundable under EU consumer protection law exceptions. Monthly retainers may be canceled with 14 days' notice before the next billing cycle. Past payments are non-refundable.

9. Service Availability

Services may be provided via third-party platforms such as ActiveCampaign, GetResponse, Skool, or Teachable. The Company is not liable for third-party service interruptions. The Client must ensure access and correct information. The Company does not provide technical support for external systems beyond setup scope.

10. Data Privacy and Security

The Company complies with GDPR. Email, phone number, and tracking pixels may be collected and used to provide services. Data is stored securely and may be processed using third-party platforms. Clients may request deletion of their data at any time. For more, see our Privacy Policy.

11. Liability Limitations

The Company is not liable for direct or indirect damages resulting from the use of the services, including loss of revenue, business interruption, or data loss. All services are used at the Client's own risk. The Client assumes full responsibility for implementing recommendations or tools provided.

12. Governing Law and Disputes

These terms are governed by Finnish law. Disputes shall first be resolved through negotiation. If unresolved, the matter shall be settled in the court of the Company's domicile unless consumer protection laws provide otherwise.

13. Updates to Terms

The Company reserves the right to update these terms at any time. The Client is responsible for reviewing terms regularly. Continued use of the services indicates acceptance of updated terms.
